DOUTS Membership Terms of Registration
Version 1.0 — August 2026
These Membership Terms of Registration (“Terms”) apply to membership of the Diving Organisation of the University of Technology Sydney Inc. (“DOUTS” or “the Club”).
By applying for or renewing membership of DOUTS, you acknowledge that you have read and agree to these Terms.
1. Membership
Membership of DOUTS is subject to the Club's Constitution, Regulations and any eligibility or approval requirements applicable to the relevant membership category.
Applicants must provide accurate information when applying for or renewing membership and must not knowingly misrepresent information relevant to their membership or participation in Club activities.
Membership of DOUTS does not constitute an endorsement or assessment by the Club of a member's diving qualifications, competence, experience, medical fitness or suitability to undertake any particular activity.
2. Club Rules and Conduct
Members agree to comply with:

the DOUTS Constitution;

the DOUTS Regulations;
-
the DOUTS Code of Conduct;
-
applicable DOUTS policies and safety requirements; and
-
reasonable requirements applying to Club activities or the use of Club property.
The DOUTS Code of Conduct establishes the standards of behaviour and personal responsibility expected of members participating in Club-facilitated activities.
Members are responsible for familiarising themselves with Club requirements relevant to activities in which they participate.
3. Nature of the Club
DOUTS is a not-for-profit recreational diving club operated primarily by volunteers.
The Club facilitates opportunities for members to participate in recreational diving and related activities. Unless expressly stated otherwise for a particular activity, DOUTS does not provide professional dive supervision, instruction or guiding.
A Club member may hold professional diving, boating, medical, first aid or other qualifications. Unless that person has expressly undertaken a professional role for a particular activity, possession of such qualifications does not mean that they are acting in that professional capacity.
Advice, observations or assistance provided informally by members or Club volunteers do not replace a member's own training, judgement or responsibility.
4. Participation in Club Activities
Membership does not automatically entitle a member to participate in every Club activity.
Activities may have requirements relating to certification, experience, age, medical fitness, equipment, capacity or other safety and operational considerations.
Members are responsible for ensuring that activities they undertake are appropriate to their qualifications, training, experience, physical condition and personal capabilities.
Participation in Club activities may also be subject to separate Event Registration Terms, Risk Warnings or Participant Waivers presented when registering for an activity.
DOUTS or an Event Organiser may decline or restrict participation where reasonably necessary in accordance with the Club's Code of Conduct, policies or applicable safety requirements.
5. Club Equipment and Property
Members must take reasonable care of Club equipment, vessels, vehicles and other property made available to them.
Members must:

use Club property only for its intended purpose and in accordance with applicable Club requirements;

ensure they are appropriately competent and, where required, authorised or licensed to use it; and
-
report known or suspected faults, damage or loss as soon as reasonably practicable.
The Club may seek reasonable repair or replacement costs where Club property is lost or damaged through deliberate misuse, unauthorised use or a failure to take reasonable care.
Ordinary wear, equipment failure or damage occurring despite reasonable use will not ordinarily be treated as the member's responsibility.
6. Membership Fees and Refunds
Membership fees are determined in accordance with the Club's Constitution and Regulations.
Payment of a membership fee relates to membership of DOUTS and does not guarantee participation in any particular event, access to any particular Club asset or the continued availability of any particular membership benefit.
Unless required by law or otherwise determined by the Club, membership fees are not ordinarily refundable merely because a member does not use the benefits of membership or ceases participating in Club activities during the membership period.
Fees paid for individual events or activities are subject to the conditions applying to those events and are separate from membership fees.
7. Suspension, Restriction and Cessation of Membership
Membership, and any action taken in relation to a member's conduct or participation, is governed by the DOUTS Constitution and applicable Regulations and policies.
Nothing in these Terms creates a separate disciplinary power or permits the Club to take action inconsistent with the Constitution.
8. General
These Terms are governed by the laws applicable in New South Wales, Australia.
Nothing in these Terms excludes, restricts or modifies any right, guarantee, duty or remedy that cannot lawfully be excluded, restricted or modified.
If a provision of these Terms is invalid or unenforceable, it is to be read down where possible or otherwise severed without affecting the remaining provisions.
DOUTS may amend these Terms from time to time. The version applying to a membership registration or renewal is the version presented or made available at the time that registration or renewal occurs.
9. Acceptance
By applying for or renewing DOUTS membership, you confirm that:

you have read and agree to these Membership Terms of Registration;

the information you have provided to DOUTS is accurate to the best of your knowledge;

you agree to comply with the DOUTS Constitution, Regulations and Code of Conduct; and
-
you understand that participation in individual Club activities may be subject to additional event-specific conditions and risk acknowledgements.
